Jim Hunt Wins New York Appeal

Jim Hunt recently won an appeal before the New York Appellate Court in a commercial litigation case arising out of a contractual dispute. The case, which was originally filed in Nassau County, was mistakenly transferred to the Richmond County Supreme Court by the Richmond County court.
Our appeal of this decision resulted in a unanimous ruling by a four-judge appellate panel that the transfer of the case from Nassau County Supreme Court to Richmond County Supreme Court was not only untimely but also procedurally incorrect. The Appellate Court sent the case back to the proper court, which is Nassau County, where our client is located. This ruling will prove important moving forward because it places the case back in the client’s “backyard” so it will have home field advantage, of sorts, at the courthouse.
